If, in a particular case, the Committee concludes that there has been a violation, the State party is invited to remedy the violation in accordance with the obligation contained in article 2, paragraph 3, of the Covenant to provide an effective remedy for violations of the Covenant.
The recommended remedy may take a specific form, such as compensation, repeal or amendment of a law, and/or release of a detained person. The case is then referred to the Special Rapporteur of the Views Follow-up Committee, who contacts the parties with a view to reaching a satisfactory solution to the case in the light of the Committee's views. In many cases, victims have been able to recover their violated rights through the process provided for in the Optional Protocol. In addition, laws and policies have been amended to eliminate similar violations in the future. Each year, the results of the State party's fact-finding and remedy activities are reflected in the Committee's annual report.
