The ECHR judgment of 28 November 2017 in the case of Kolesin v. The Russian Federation (application No. 72885/10).
The case successfully examined the applicant's complaint about inadequate conditions of detention and that at one time his detention was unlawful, since he could not deposit the amount of the security because of a lack of a deposit account with the court and was forced to remain in custody. The case involved a violation of the requirements of article 5, paragraph 1, of the Convention for the Protection of Human Rights and Fundamental Freedoms.
In 2010, the applicant was assisted in preparing the application. Subsequently, the application was communicated to the Russian Federation.
In his complaint, the applicant complained about inadequate conditions of detention and that at one time his detention was unlawful, since he could not deposit the amount of the security because of a lack of a deposit account with the court and was forced to remain in custody.
On 28 November 2017, on a complaint lodged by the applicant, the Court, taking into account the unilateral declaration of the authorities concerning the conditions of the applicant's detention, unanimously held that in the present case the Government violated the requirement of Article 5 § 1 of the Convention (right to liberty and security of the person) and ordered the respondent State to pay the applicant 1,375 euros as just satisfaction.
