ECHR judgment of October 29, 2019 in the case of Novaya Gazeta and Borodyanskiy (Novaya Gazeta and Borodyanskiy) v. Russia (application No. 42113/09).
In 2009, the applicants were assisted in preparing the application. Subsequently, the application was communicated to the Russian Federation.
The case has successfully examined the application that the institution of defamation proceedings against the applicants violated their right to freedom of expression. The case has violated the requirements of Article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
In their application, the applicants complained that the institution of defamation proceedings against them violated their right to freedom of expression.
On 29 October 2019, in an application submitted by the applicants, the Court unanimously ruled that in the present case the Government violated the requirements of Article 10 of the Convention (the right to freedom of expression) and ordered the respondent Government to pay the applicant newspaper 1,160 euros in in respect of pecuniary damage and EUR 1,000 in respect of non-pecuniary damage to the applicant newspaper and the applicant.
