The ECHR judgment of August 27, 2019 in the case of Rodionov v. Russia (application No. 9106/09).

In 2019, the applicant's mother was assisted in preparing the application.

In the case, the application for reviewing, in connection with the death of the applicant, the decision of the ECHR, which found a violation in respect of the applicant of Article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms, taken separately and in conjunction with Article 13, paragraphs 3 and 4 of Article 5, paragraph 1 and subparagraphs b and c of paragraph 3 of Article 6, Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms, taken separately and in conjunction with Article 13, as well as Articles 10 and 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms. The application was granted, the amounts awarded to the applicant were decided to be paid to his successor.

On December 11, 2018, the European Court delivered a judgment in the Rodionov v. Russian Federation case, in which it held that there had been a violation of Article 3 of the Convention (prohibition of torture), taken separately and in conjunction with Article 13 of the Convention (right to an effective domestic remedy legal protection), paragraphs 3 and 4 of Article 5 of the Convention (right to liberty and security of person), paragraph 1 and subparagraphs “b” and “c” of paragraph 3 of Article 6 of the Convention (right to a fair trial), Article 8 of the Convention (right to respect for private and emeynoy life), taken alone and in conjunction with Article 13 of the Convention and Articles 10 (freedom of expression) and 34 of the Convention (right of individual petition). The Court awarded the applicant EUR 12,700 in respect of non-pecuniary damage and EUR 3,500 in respect of costs and expenses.

On January 16, 2019, the applicant's mother notified the Court that the applicant had died on May 22, 2018, and submitted a motion to review the judgment in the manner prescribed by Rule 80 of the Rules of Court.

On 27 August 2019, at the request of the applicant’s mother, the European Court unanimously accepted the application for revision of the judgment of 11 December 2018 and decided that the Russian authorities should pay the amounts awarded to the applicant to Tatyana Nikolayevna Rodionova, the heiress of the deceased applicant.
