The ECHR judgment of July 23, 2019 in the case of Kadadov and Pereverzev v. Russia (applications Nos. 18820/17 and 20413/17).
In 2017, the applicants were assisted in preparing applications. Subsequently, the applications were consolidated and communicated by the Russian Federation.
In the case, the applications was successfully examined that the court that considered cases on bringing the applicants to administrative responsibility was not impartial due to the non-participation of the prosecution in the court session. In the case, there was a violation of the requirements of paragraph 1 of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
In their applications, the applicants complained that the court, which examined cases on bringing them to administrative responsibility, was not impartial due to the non-participation of the prosecution in the court session.
On July 23, 2019, according to the applications filed by the applicants, the Court unanimously ruled that in the present case the Government had violated the requirement of Article 6 § 1 of the Convention (right to a fair trial).
