The ECHR has found a violation of Article 5 § 4 of the Convention for the Protection of Human Rights and Fundamental Freedoms and Rule 39 of the Rules of Court.

The ECHR judgment of July 9, 2019 in the case of “R.A. (R.A.) v. Russian Federation” (application No. 2592/17).

The case has successfully examined the application about the excessive length of the examination of the applicant's complaint about his detention, as well as the fact that the applicant was expelled to Uzbekistan in violation of the preliminary measures prescribed by the European Court in accordance with Rule 39 of the Rules of Court. There was a violation of the requirements of Article 5 § 4 of the Convention for the Protection of Human Rights and Fundamental Freedoms and Rule 39 of the Rules of Court.

In 2017, the applicant was assisted in preparing the application. Subsequently, the application was communicated to the Russian Federation.

In his application, the applicant complained about the excessive length of the examination of his complaint about his detention. The applicant alleged that his removal to Uzbekistan had been carried out in violation of the preliminary measures prescribed by the European Court in accordance with Rule 39 of the Rules of Court.

On July 9, 2019, on an application lodged by the applicant, the European Court unanimously ruled that in the present case the Russian authorities violated the requirements of Article 5 § 4 of the Convention (right to liberty and security of person) and Rule 39 of the Rules of Court, and ordered the authorities of the respondent Government to pay the applicant EUR 5,000 in respect of non-pecuniary damage, EUR 3,640 in respect of costs and expenses.
