ECHR judgment of July 2, 2019 in the case of Ryabinina and Others v. Russia (applications N 50271/06, 4718/07, 24121/07, 7624/08, 53088/08, 64311/10, 6737 (11, 74971/11 and 64746/13).
The case has successfully examined applications of a violation of the applicants' rights to freedom of expression and freedom of assembly, and some applicants are complaining about the lack of effective domestic remedies in respect of these violations or in connection with their unlawful detention. The case has violated paragraph 1 of Article 5 of the Convention for the Protection of Human Rights and Fundamental Freedoms (right to liberty and security of person), Articles 11 (right to freedom of assembly and association) and 13 of the Convention (right to an effective domestic remedy).
In 2006, 2007, 2008, 2010, 2011 and 2013, the applicants were assisted in preparing applications. Subsequently, the applications were consolidated and communicated by the Russian Federation.
In their applications, the applicants complained of a violation of their rights to freedom of expression and freedom of assembly. Some of the applicants also argued that there were no effective domestic remedies in respect of these violations or in connection with their unlawful detention.
On July 2, 2019, on applications submitted by the applicants, the European Court unanimously ruled that in the present case the Russian authorities violated the requirements of Article 5 § 1 of the Convention (right to liberty and security of person), Articles 11 (right to freedom of assembly and association) and 13 of the Convention ( the right to an effective domestic remedy) and ordered the respondent Government to pay the applicants various amounts from 5,015 to 10,000 euros in respect of non-pecuniary damage.
