The ECHR judgment of July 2, 2019 in the case of Gorlov and Others v. Russia (applications N 27057/06, 56443/09 and 25147/14).
In the case, applications about the constant video surveillance of the applicants by cameras, sometimes carried out by female security guards, the inability of the second applicant to exercise outdoors in the winter due to the failure to provide him with appropriate winter shoes, and the lack of effective remedies at the second and third applicants connection with violations committed against them. The case violated Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms (the right to respect for private and family life), Article 13 of the Convention (the right to an effective domestic remedy) taken in conjunction with Article 8 of the Convention.
In 2006, 2009 and 2014, the applicants were assisted in preparing applications. Subsequently, the applications were consolidated and communicated by the Russian Federation.
In their applications, the applicants complained that the constant video surveillance of their cameras, sometimes carried out by female security guards, violates their right to respect for their privacy, guaranteed by Article 8 of the Convention. The second applicant also complained that he could not exercise outdoors in the winter because he was not provided with the appropriate winter shoes. The second and third applicants alleged that they had had no effective remedy in respect of the violations committed against them.
On July 2, 2019, on applications submitted by the applicants, the European Court unanimously ruled that in the present case the Russian authorities violated the requirements of Article 8 of the Convention (right to respect for private and family life), Article 13 of the Convention (right to an effective domestic remedy), taken in in conjunction with Article 8 of the Convention. The European Court, with five votes in favor and two against, held that the finding of a violation of the Convention was in itself a fairly just satisfaction. The second and third applicants were awarded EUR 1,800 and EUR 2,000, respectively, in respect of costs and expenses.
