The ECHR judgment of June 18, 2019 in the case of Vladimir Ushakov v. Russia (application No. 15122/17).

In 2017, the applicant was assisted in preparing the application. Subsequently, the application was communicated to the Russian Federation.

The case has successfully examined an application about a violation of the applicant’s rights to respect for family life in connection with the refusal of the court of the Russian Federation to decide on the return of his daughter to Finland in accordance with the Hague Convention on Civil Aspects of International Child Abduction. The case has violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

In his application, the Applicant complained that in connection with the refusal of the court of the Russian Federation to decide on the return of his daughter to Finland in accordance with the 1980 Hague Convention on Civil Aspects of International Child Abduction, he was a victim of a violation of his right to respect for family life.

On June 18, 2019, on an application filed by the applicant, the European Court, by six votes in favor and one against, decided that in the present case the Russian authorities had violated the requirements of Article 8 of the Convention (the right to respect for private and family life), and obliged the authorities of the respondent State to pay the applicant EUR 16,250 in respect of non-pecuniary damage and EUR 6,800 in respect of costs and expenses.
