The ECHR judgment of March 5, 2019 in the case of Bogonosovy v. Russia (Bogonosovy v. Russia) (application No. 38201/16).
The case has successfully examined an application about violation of the right to maintain family ties and the lack of effective domestic remedies in this regard. The case has violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
In 2016, the applicants were assisted in preparing the application. Subsequently, the application was communicated to the Russian Federation.
In their application, the applicants complained of a violation of their right to maintain family ties with their granddaughter and the lack of effective domestic remedies in this regard.
On 05 March 2019, in an application submitted by the applicants, the Court unanimously ruled that in the present case the Government violated the requirements of Article 8 of the Convention (the right to respect for private and family life) and ordered the respondent Government to pay the second applicant 5,000 euros in as fair compensation.
