ECHR judgment of February 21, 2019 in the case of Ananchev and Others v. Russia (Ananchev and Others v. The case has successfully examined applications about the excessive length of pre-trial detention and the length of the judicial review of the lawfulness of the election of a preventive measure, the inability to personally participate in court proceedings. The case has violated the requirements of paragraph 3 of Article 5 of the Convention for the Protection of Human Rights and Fundamental Freedoms, paragraph 4 of Article 5 of the Convention in respect of 3 applicants, paragraph 1 of Article 6 of the Convention in respect of 1 applicant.

In 2010, 2014 and 2017, the applicants were assisted in preparing applications. Subsequently, the applications were consolidated and communicated by the Russian Federation.

In their applications, the applicants (26 persons) complained about the excessive length of their pre-trial detention. Three applicants complained about the excessive length of the judicial review of the lawfulness of the choice of a preventive measure. One applicant complained that he had not been given the opportunity to personally participate in civil proceedings in the case in which he was a party.

On February 21, 2019, according to the applications submitted by the applicants, the Court unanimously ruled that in the present case the Russian authorities violated the requirements of Article 5 § 3 of the Convention (right to liberty and security of person) in respect of all applicants, Article 5 § 4 of the Convention in respect of three the applicants, Article 6 § 1 of the Convention (right to a fair trial) in respect of one applicant, and ordered the respondent Government to pay the applicants various amounts from 500 to 9,200 euros in respect of moral damages flax damage.
