Decision of the ECHR of December 18, 2018 in the case of Kulbashin (Russian Federation) (application No. 25895/05).
The case was successfully examined by the application that the length of the proceedings in his civil case was incompatible with the “reasonable time” requirement, as well as the non-execution of the decision in his favor against the state unitary enterprise and the lack of effective remedies in this regard. The case has violated the requirements of paragraph 1 of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
In 2005, the complainant was assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.
In his application, the Claimant complained that the length of the proceedings in his civil case was incompatible with the “reasonable time” requirement, as well as the failure to execute the decision in his favor against the state unitary enterprise and the lack of effective remedies in this regard.
On 18 December 2018, on the application submitted by the applicant, the European Court unanimously decided that in the present case the authorities violated the requirement of Article 6 § 1 of the Convention (the right to a fair trial) regarding the length of the proceedings, and ordered the respondent state to pay the applicant 750 euros as compensation for non-pecuniary damage.
