ECHR Ordinance of December 11, 2018 in the case of Akchay and Others (Russian Federation) (application N 66729/16).

The case was successfully considered by the applicants that the annulment of the first applicant’s residence permit (a Turkish citizen) on the basis of undisclosed information violated their right to respect for family life, and there was no effective domestic remedy in this regard. The case has violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

In 2016, complainants were assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.

In their application, the applicants (a family of three) complained that the cancellation of the first applicant’s residence permit (a Turkish citizen) on the basis of undisclosed information violated their right to respect for family life. They also argued that there was no effective domestic remedy in this regard.

On 11 December 2018, on the application filed by the applicants, the European Court unanimously decided that in the present case the authorities violated the requirement of Article 8 of the Convention (the right to respect for private and family life), and ordered the respondent state to pay the applicants jointly EUR 12,000 moral damages.
