ECHR judgment of November 27, 2018 in the case of Ruzhnikov v. Russia (application No. 2223/14).

The case was successfully considered the application of the complainant that some of the language used by the domestic court during the consideration of the complaint in a civil case about his dismissal from the Department of Internal Affairs before sentencing him violated his right to the presumption of innocence. The case has violated the requirements of paragraph 2 of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

In 2014, the complainant was assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.

In his application, the Complainant complained that some of the language used by the domestic court during the consideration of the complaint in a civil case about his dismissal from the administration of the Ministry of Internal Affairs for the Belgorod Region before sentencing him violated his right to the presumption of innocence.

On November 27, 2018, on the application filed by the applicant, the European Court unanimously decided that in the present case the authorities violated the requirement of Article 6 § 2 of the Convention (the right to a fair trial). The European Court also decided that the finding of a violation of the Convention is in itself a sufficient form of compensation.
