ECHR judgment of November 20, 2018 in the case of Samesov (Russian Federation) (application N 57269/14).

The case was successfully considered the application of the applicant, who was a citizen of the Republic of Belarus, that he had been ill-treated by the police, as well as that no effective investigation had been carried out in this connection. The case has violated the requirements of Article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

In 2014, the complainant was assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.

In his application, the applicant, who was a citizen of the Republic of Belarus, complained that he had been ill-treated by the police, and that no effective investigation had been carried out in this connection.

On 20 November 2018, on the application submitted by the applicant, the European Court unanimously decided that in the present case the authorities violated the requirements of Article 3 of the Convention (prohibition of torture) in its substantive and procedural aspects, and ordered the respondent state to pay the applicant 20,000 euros moral damages.
