ECHR ruling of November 13, 2018 in the case of Arzhiyeva and Tsadayev (Russian Federation) v. (applications N 66590/10 and 3773/11).

The case has successfully examined the applicants' applications about the violation of their property rights due to the inability to receive compensation for property lost by them during the counter-terrorist operation in the Chechen Republic. The case has violated the requirements of Article 1 of Protocol No. 1 to the Convention for the Protection of Human Rights and Fundamental Freedoms.

In 2010 and 2011, complainants were assisted in preparing applicationts. Subsequently, the applications were merged and communicated to the Russian Federation.

In their applications, the applicants complained about the violation of their property rights due to the inability to receive compensation for property lost by them during the counter-terrorist operation in the Chechen Republic.

On November 13, 2018, according to the applications filed by the applicants, the European Court unanimously decided that in this case the authorities violated the requirements of Article 1 of Protocol No. 1 to the Convention (protection of property), and ordered the respondent state to pay each applicant 5,000 euros in as compensation for non-pecuniary damage and 4,600 euros as compensation for pecuniary damage.
