ECHR ruling dated October 23, 2018 in the case of Petrov and X (Petrov and X) v. Russia (application No. 23608/17).

The case was successfully considered by the applicants' application that the refusal to make a decision on the second applicant’s residence together with the first one violated their right to respect for family life and, moreover, constituted discrimination on the basis of sex, since, presumably without justified reasons, the decision on the place of residence child was rendered in favor of the mother. The case has violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

In 2016, complainants were assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.

In their application, the applicants (father and son) complained that the refusal to make a decision on the second applicant’s residence together with the first violated their right to respect for family life and, moreover, constituted discrimination on the basis of sex, because allegedly without justified reasons about the place of residence of the child was rendered in favor of the mother.

On 23 October 2018, on a application filed by the applicants, the European Court unanimously decided that in the present case the authorities violated the requirements of Article 8 of the Convention (the right to respect for private and family life), and ordered the respondent state to pay the applicant 12,500 euros as compensation moral harm.
