ECHR judgment of October 23, 2018 in the case of A.N. and others (A.N. and Others) against the Russian Federation (applications No. 61689/16, 20421/17, 23188/17 and 37702/17).
The case has successfully examined the applications of the complainants that if they are deported to their countries of origin, they will be subjected to treatment contrary to Article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms. In the case, there will be a violation of Article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms in the event of the expulsion / extradition of three applicants.
In 2016 and 2017, complainants were assisted in preparing applications. Subsequently, the applications were merged and communicated to the Russian Federation.
In their applications, the applicants (four people, citizens of Tajikistan or Uzbekistan) complained that if they were deported to their countries of origin, they would be subjected to treatment contrary to Article 3 of the Convention.
On 23 October 2018, on applications filed by the applicants, the European Court unanimously decided that in the event of the expulsion / extradition of the three applicants, there would be a violation of Article 3 of the Convention (prohibition of torture). The European Court decided that the finding of a violation of the Convention is in itself a sufficient form of compensation.
