ECHR judgment of October 2, 2018 in the case of Fedchenko (Fedchenko) against the Russian Federation (N 4) (Complaint N 17221/13).
The case was successfully considered the complaint of the applicant, who was the editor of the newspaper, that the initiation of a defamation case against him violated his right to freedom of expression. The case has violated the requirements of Article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
In 2013, the complainant was assisted in preparing a complaint. Subsequently, the complaint was communicated to the Russian Federation.
In his complaint, the complainant, who was the editor of the Bryansk weekdays newspaper, complained that the defamation proceedings against him violated his right to freedom of expression.
On 2 October 2018, on a complaint filed by the applicant, the European Court unanimously decided that in the present case the authorities violated the requirements of Article 10 of the Convention (the right to freedom of expression), and ordered the respondent state to pay the applicant 7,500 euros in compensation for moral harm.
