Resolution of the European Court of Human Rights dated October 2, 2018 in the case “A.B.V. (A.B.V.) against the Russian Federation” (Complaint No. 56987/15).
The case was successfully considered the complaint of the applicant that the domestic authorities had not provided him with effective assistance in establishing contacts with his daughter after the termination of his joint residence with the child’s mother. The case has violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
In 2015, the complainant was assisted in preparing a complaint. Subsequently, the complaint was communicated to the Russian Federation.
In his complaint, the applicant complained that the domestic authorities had not provided him with effective assistance in establishing contacts with his daughter after he had ceased living together with the child’s mother.
On 2 October 2018, according to the complaint submitted by the applicant, the European Court unanimously decided that in the present case the authorities violated the requirement of Article 8 of the Convention (the right to respect for private and family life), and ordered the respondent state to pay the applicant 12,500 euros as compensation moral harm.
