ECHR ruling dated August 28, 2018 in the case of Ibragim Ibragimov and Others (Ibragim Ibragimov and Others) v. Russia (application No. 1413/08).
The case has successfully examined the complaints of the complainants that the ban on the publication and distribution of Muslim books of a religious nature that are on the list of prohibited materials violated their right to freedom of expression and freedom of religion. The case has violated the requirements of Article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms (freedom of expression).
In 2008, complainants were assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.
In their application, the applicants, a citizen of the Russian Federation and two non-profit organizations, complained that the ban on the publication and distribution of Muslim books of a religious orientation that were on the list of prohibited materials violated their right to freedom of expression and freedom of religion.
On 28 August 2018, the European Court unanimously ruled that in the present case the authorities violated the requirements of Article 10 of the Convention (freedom of expression) and ordered the respondent state to pay the first applicant EUR 7,500 in compensation for non-pecuniary damage. The other two applicants did not submit any claim for compensation, therefore the Court did not award anything in this connection.
