ECHR judgment of July 17, 2018 in the case of Voroshilov (Voroshilov) against the Russian Federation (application No. 59465/12).
The case successfully examined the complainant’s complaint that he had been ill-treated during his detention, the minor punishments imposed on the persons responsible for this ill-treatment, and that the amount of compensation awarded to him by the defendant’s courts was insufficient. The applicant also complained that he did not have effective remedies. The case has violated the requirements of Article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms (prohibition of torture), there is no violation of Article 13 of the Convention (the right to an effective remedy).
In 2012, the complainant was assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.
In his application, the complainant complained that he had been ill-treated during his detention, the minor punishments imposed on the perpetrators of this ill-treatment, and that the amount of compensation awarded to him by the defendant’s courts was insufficient. The applicant also complained that he did not have effective remedies.
On July 17, 2018, the European Court unanimously decided that in the present case the authorities of the Russian Federation had violated the requirement of Article 3 of the Convention (prohibition of torture) on the complaint filed by the applicant. The court also ruled that there was no violation of Article 13 of the Convention (the right to an effective remedy). The court ordered the respondent State to pay the applicant EUR 17,500 in respect of non-pecuniary damage.
