ECHR ruling dated July 3, 2018 in the case of Voynov v. Russia (application N 39747/10).

The case was successfully considered the complaint of the applicant that his right to respect for family life was violated in connection with the direction to serve his sentence in a colony located 4,200 km from the place of residence of his family. He also complained about the lack of effective remedies in this regard. The case has violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms (the right to respect for private and family life), Article 13 of the Convention (the right to an effective remedy).

In 2010, the complainant was assisted in preparing a application. Subsequently, the complaint was communicated to the Russian Federation.

In his application, the complainant complained that his right to respect for family life had been violated in connection with the referral to the colony, located 4,200 km from the place of residence of his family. He also complained about the lack of effective remedies in this regard.

On July 3, 2018, the European Court unanimously ruled that in the present case the authorities violated the requirement of Article 8 of the Convention (the right to respect for private and family life), Article 13 of the Convention (the right to an effective remedy), and ordered the State - the respondent to pay the applicant 6,850 euros in compensation.

The concurring opinion was expressed by the judge of the European Court of Human Rights M. Elosega (elected from Spain).
