The case successfully examined the complaint of the applicant, who is a citizen of the Republic of Kazakhstan and is married to a citizen of the Russian Federation, that the decision to deport on the grounds that he was a threat to national security without disclosing relevant information violated his right to respect for his family life. The case has violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms (the right to respect for private and family life).
In 2010, the complainant was assisted in preparing an application. Subsequently, the application was communicated to the Russian Federation.
In his complaint, the complainant, who is a citizen of the Republic of Kazakhstan and married to a citizen of the Russian Federation, complained that the decision to deport on the grounds that he was a threat to national security without disclosing relevant information violated his right to respect for his family life.
On 12 June 2018, the European Court unanimously ruled that in the present case the authorities violated the requirement of Article 8 of the Convention (the right to respect for private and family life), and ordered the respondent state to pay the applicant 12,500 euros as fair compensation.
