The ECHR found a violation of the requirements of Article 3, Article 13 of the Convention and Article 6 § 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

The case was successfully examined by the complainant about the inhuman conditions of detention, and that he did not have an effective remedy in this regard. The applicant also complained that he was not ensured the possibility of personal participation in the proceedings in civil proceedings. The case has violated the requirements of article 3 of the Convention (prohibition of torture), article 13 of the Convention (the right to an effective remedy), paragraph 1 of article 6 of the Convention (the right to a fair trial).

In 2009, the complainant was assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.

In his complaint, the applicant complained about the inhuman conditions of detention and that he did not have an effective remedy in this regard. The applicant also complained that he was not ensured the possibility of personal participation in the proceedings in civil proceedings.

On 10 April 2018, the European Court unanimously ruled that in the present case the authorities violated the requirement of Article 3 of the Convention (prohibition of torture), Article 13 of the Convention (the right to an effective remedy), the requirement of Article 6 § 1 of the Convention ( the right to a fair trial), and ordered the respondent Government to pay the applicant 9,250 euros (EUR) in respect of non-pecuniary damage.
