The case successfully reviewed the complaints of the applicants, who were given court decisions to recalculate the social benefits they were entitled to, that the illegal extension by the courts of the period for filing appeals led to the decision rendered in their favor. The case has violated the requirements of Article 6 § 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms (the right to a fair trial).
In 2009, complainants were assisted in preparing applications. Subsequently, the applications were merged and communicated to the Russian Federation.
In their complaint, the claimants, who had been given recourse of their social benefits by court decisions, complained that the unlawful extension of the time limit for filing appeals by the courts had resulted in the annulment in their favor.
On May 29, 2018, on complaints filed by the applicants, the European Court unanimously decided that in the present case the authorities violated the requirement of Article 6 § 1 of the Convention (the right to a fair trial). The finding of a violation was in itself recognized as sufficient compensation.
