The case was successfully considered the complaint of the applicants detained at one of the polling stations during the elections to the Moscow City Duma for misconduct, that the detention reports were drafted with a considerable delay, the decisions on the choice of preventive measures did not indicate any period, and the decision of the court on immediate release was also executed with a delay due to the long mailing of the decision. The case has violated the requirements of Article 5 § 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms (the right to liberty and security of person).
In 2007, complainants were assisted in preparing an application. Subsequently, the application was communicated to the Russian Federation.
In their complaint, the applicants (three people) who were detained at one of the polling stations during the elections to the Moscow City Duma in 2007 for misconduct complained that the detention reports were drafted with a considerable delay, in decisions on the choice of preventive measures no time was indicated, and the court’s decision on immediate release was also delayed due to the long mailing of the decision.
On 10 April 2018, the European Court unanimously ruled that in the present case the authorities violated the requirements of Article 5 § 1 of the Convention (the right to liberty and security of person) and ordered the respondent government to pay each applicant 7,500 euros as a compensation. One of the applicants died before the European Court of Justice, the compensation was paid to his mother.
