ECHR judgment of July 17, 2018 in the case of Fefilov v. Russia (application N 6587/07).
The case successfully examined the complainant’s complaint that he was at risk of acquiring HIV while serving his sentence in a correctional facility, and that his conviction was based on his confession obtained under duress and during the time when he did not have a lawyer. In the case of a violation of the requirements of paragraph 1 and subparagraph "c" of paragraph 3 of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms (right to a fair trial).
In 2007, the complainant was assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.
In his application, the complainant complained that he was at risk of acquiring HIV while serving his sentence in a correctional institution, and that his conviction was based on his confession obtained under duress and during the time when he did not have a lawyer.
On July 17, 2018, the European Court unanimously ruled that in the present case the authorities violated the requirement of clause 1 and sub-clause 3 of Article 6 of the Convention (the right to a fair trial), and ordered the respondent state to pay the applicant 4 000 euros in compensation.
