The ECHR found a violation of the requirements of Article 10 and Clause 1 and Sub-Clause 3 (c) of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

The case successfully reviewed the complaint of the applicants who organized a protest action in the building of the Presidential Administration, that their arrest, pre-trial detention and the sentence imposed on them at the end of the criminal proceedings violated their right to freedom of expression and the right to freedom of assembly. The applicants also complained that they were not ensured the right to confidential communication with a lawyer during the hearing. The case has violated the requirements of Article 10 of the Convention (freedom of expression), clause 1, and sub-clause c of clause 3 of Article 6 of the Convention (right to a fair trial).

In 2006, applicants were assisted in preparing an application. Subsequently, the application was communicated to the Russian Federation.

In their complaint, the applicants (24 people), who organized a protest action in the building of the Presidential Administration on December 14, 2004, complained that their arrest, pre-trial detention and the sentence imposed upon them at the end of the criminal proceedings violated their right to freedom expressions of opinion in accordance with Article 10 of the Convention and the right to freedom of assembly under Article 11 of the Convention. The applicants also complained that they were not ensured the right to confidential communication with a lawyer during the hearing.

On April 17, 2018, on the complaint submitted by the applicants, the European Court unanimously ruled that in this case the authorities violated the requirements of Article 10 of the Convention (freedom of expression), the requirement of paragraph 1 and subparagraph “c” of Article 6 of the Convention (right to a fair judicial proceedings), and ordered the respondent State to pay each applicant 12,500 euros in compensation.
