ECHR judgment of July 17, 2018 in the case of Pylayevy v. Russia (application N 61240/15).

The case was successfully considered by the applicants' complaint that their right to respect for private and family life was violated due to their eviction after the first applicant’s retirement from the apartment provided by the Prosecutor’s Office of Primorsky Krai, which the applicant used under the lease agreement. The case has violated the requirements of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms (the right to respect for private and family life).

In 2015, claimants were assisted in preparing a application. Subsequently, the application was communicated to the Russian Federation.

In their application, the applicants, the former prosecutor’s office and his mother, complained that their right to respect for private and family life was violated due to their eviction after the first applicant’s retirement from the apartment provided by the prosecutor’s office in Primorye Territory rent.

On July 17, 2018, the European Court unanimously ruled that in the present case the authorities violated the requirement of Article 8 of the Convention (the right to respect for private and family life) and ordered the respondent State to pay the applicant 9,500 euros as compensation for moral damage.
