The case was successfully considered the complaint of the applicants, who were employees of the municipal educational institution, that the prolonged non-execution of court decisions on the reimbursement of unpaid wages and fees to various social funds violated their rights. The applicants also stated that the incomplete enforcement of court decisions violated their right to property. The case has violated the requirements of Article 6 § 1 of the Convention (the right to a fair trial) in terms of length, Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 to the Convention (protection of property) in terms of non-enforcement of a final court decision.
In 2006, applicants were assisted in preparing an applications. Subsequently, the application was communicated to the Russian Federation.
In their complaint, the applicants (six people), who were employees of a municipal educational institution, complained that the long non-execution of court decisions on the reimbursement of unpaid wages and fees to various social funds violated their rights. The applicants also stated that the incomplete enforcement of court decisions violated their right to property.
On 12 June 2018, on the complaint submitted by the applicants, the European Court unanimously decided that in the present case the authorities violated the requirement of Article 6 § 1 of the Convention (the right to a fair trial) in terms of length, the requirement of Article 6 § 1 of the Convention and Article 1 of Protocol N 1 to the Convention (protection of property) in terms of non-execution of a final court decision. The European Court ordered the respondent State to pay the applicants 44,916 euros as a fair compensation. Applicants were awarded various amounts from 7,252 to 8,235 euros.
